World Sleep Day Competition T&Cs

1. The Promoter

The prize draw promoter is Caledonian Sleeper Limited a company incorporated and registered in Scotland with company number SC328825 whose registered office is Basement And Ground Floor Premises, 1-5 Union Street, Inverness, Scotland, IV1 1PP (“Caledonian Sleeper”)

2. The Prize Draw

2.1. The title of the prize draw is “Win the ultimate sleep with Caledonian Sleeper”.

2.2. Entry into the prize draw can be completed through its prize draw form at www.sleeper.scot/win-the-ultimate-sleep-with-caledonian-sleeper

2.3. The Prize includes:

• A complimentary return journey on the Caledonian Sleeper for two in a Club room with en-suite, breakfast included and priority club car access
• A handcrafted Glencraft Mattress for the ultimate night’s sleep
• An overnight stay at the 5 Star Marcliffe Hotel and Spa for two
• A hamper of ARRAN Sense of Scotland’s bestselling After the Rain collection worth over £200
• Dinner for two at Six by Nico (no drinks included)

 

How to enter

‘3.1. The prize draw will run from 12.01am GMT on 15 March 2024 to 11.59pm GMT on 29 March 2024 (the “Closing Date”) inclusive.

3.2. All prize draw entries must be received by Caledonian Sleeper by no later than 11.59pm GMT on the Closing Date. All prize draw entries received after the Closing Date will be automatically disqualified.

3.3. To enter the prize draw, fill out the form, providing your Full Name and email address at www.sleeper.scot/win-the-ultimate-sleep-with-caledonian-sleeper

3.4. There is no entry fee for entering the prize draw.

3.5. Caledonian Sleeper will not accept responsibility for prize draw entries that it does not receive.

3.6. By submitting a prize draw entry, you agree to be bound by these terms and conditions. For help with entries, please contact media@caledoniansleeper.scot

3.7. The winner of the prize draw will be selected at random by software, from all entries received and verified by Caledonian Sleeper. The decision of Caledonian Sleeper regarding any aspect of the prize draw is final and binding.

4. Eligibility

4.1. The prize draw is open to everyone aged 18 years or over, except:

4.1.1. Employees of Caledonian Sleeper, Glencraft, The Marcliffe Hotel and Spa, Arran Sense of Scotland and Six by Nico

4.1.2. Employees of agents or suppliers of Caledonian Sleeper, Glencraft, The Marcliffe Hotel and Spa, Arran Sense of Scotland and Six by Nico who are professionally connected with the prize draw or its administration; or

4.1.3. Members of the immediate families or households of (4.1.1) and (4.1.2) above.

4.2. In entering the prize draw, you confirm that you are eligible to do so and eligible to claim the prize. Caledonian Sleeper may require you to provide proof that you are eligible to enter the prize draw.

4.3. There is a limit of one entry per person. Multiple entries from the same person will be disqualified.

4.4. Caledonian Sleeper reserves the right to disqualify you if your conduct is contrary to the spirit or intention of the prize draw.

4.5. Dates for travel and for the accommodation for this prize draw are as stated in clause 6.2.1 of these Terms and Conditions. No alternative dates will be offered if you are unable t travel on these dates.

4.6 Hotel check in times are 15:00 and check out time is 12:00pm

4.7  The Prize draw winner must confirm acceptance of the prize within 72 hours of being notified they are the winner of the prize draw.

4.8 In the event that prize draw winners fail to acknowledge they are the prize winner within 72 hours Caledonian Sleeper reserves the right to select an alternate winner at random.

5. Winner(s)

5.1. The decision of Caledonian Sleeper is final.

5.2. Caledonian Sleeper will contact the winner(s) of the prize, by 5pm GMT on 1^st April 2024 using the email address provided with the prize draw entry.

5.3. Caledonian Sleeper is obliged to publish or make available information that indicates that a valid award took place. To comply with this obligation, if requested by email received into media@caledoniansleeper.scot, Caledonian Sleeper will make available the winner’s name. If you object to your name being published or made available, please contact Caledonian Sleeper at media@caledoniansleeper.scot. In such circumstances, Caledonian Sleeper must still provide the information and winning entry to the Advertising Standards Authority, upon request.

5.4. The prize draw winner’s name will be available 28 days after the Closing Date by emailing media@caledoniansleeper.scot

6. Prize

6.1. Caledonian Sleeper will make all reasonable efforts to contact the winner(s). If a selected winner cannot be contacted or is not available, or has not claimed their prize by 4^th April 2024, Caledonian Sleeper reserves the right to offer the Prize to the next eligible entrant selected from the entries that were received before the Closing Date.

6.2. Complimentary Travel

6.2.1 The prize for travel on the Caledonian Sleeper service:

(a) is provided by Caledonian Sleeper Limited, 1-5 Union Street, Inverness, IV1 1PP;(b) is subject to availability;

(b) must be booked no later than 3 May 2024 and for travel to take place on or before 26 June 2024

(c). Caledonian Sleeper does not accept any responsibility, and will not provide any cash or other alternative, if you are not able to book or use or take up the Prize;

(d) is subject to the Caledonian Sleeper Limited terms and conditions, Passenger Charter and the National Rail Conditions of Carriage (together the “Guest Terms”), which can be found on our website;

(e) is not transferrable to anyone other than the prize winner, and cannot be used on rail services provided by other train operators; and

6.3. The other Prizes are supplied by:

• Glencraft, 14 Whitemyres Avenue, Aberdeen, Scotland, AB16 6HQ
• The Marcliffe Hotel and Spa, North Deeside Road, Pitfodels, Aberdeen AB15 9YA
• Arran Sense of Scotland, Home Farm, Brodick, Isle of Arran, KA27 8DD
• Six by Nico,  1132 Argyle St, Finnieston, Glasgow, G3 8TD

(the “Supplier(s)”). Caledonian Sleeper reserves the right to replace any of the Prizes with an alternative prize of equal or higher value if circumstances beyond Caledonian Sleeper’s control make it necessary to do so.

6.5. The Prizes are not negotiable or transferable and there is no cash alternative available.

6.6. Caledonian Sleeper does not accept any responsibility for inaccurate prize details being supplied by the Supplier or any other third party connected with the prize draw.

7. Limitation of Liability and Force Majeure

7.1. Insofar as is permitted by law, Caledonian Sleeper will not in any circumstances be responsible or liable to compensate the winner(s) or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by a negligent act or omission of Caledonian Sleeper.

7.2. Caledonian Sleeper shall not be in breach of these terms and conditions nor liable for delay in performing, or failure to perform, any of its obligations under these terms and conditions if such delay or failure results from events, circumstances or causes beyond its reasonable control, including without limitation, acts of God, flood, drought, earthquake (or other natural disaster), epidemic or pandemic, fire, strike or any law or action taken by a government of public authority.

8. Data Protection

8.1 Caledonian Sleeper will only process your personal information as set out in our privacy notice – https://www.sleeper.scot/privacy-policy/ See also Clause 5.3, with regard to the announcement of the winner.

: If you opt in for Caledonian Sleeper to share your personal data with Glencraft and/ or The Marcliffe and/or Arran Sense of Scotland and/or Six by Nico then we will share your personal data with them, and they will be responsible for processing your personal data (including any relevant processing of your personal data by their sub-processors). 9. General

9.1. If there is any reason to believe that there has been a breach of these terms and conditions, Caledonian Sleeper may, at its sole discretion, reserve the right to exclude you from participating in the prize draw.

9.2. Caledonian Sleeper reserves the right to hold void, suspend, cancel, or amend the prize draw where it becomes necessary to do so.

9.3. The prize draw is in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other social network. You are providing your information to Caledonian Sleeper and if selected, a partner organisation.

9.4. These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England & Wales.
